Sales Terms and Conditions

1. Preamble

The following terms and conditions (T&Cs) apply to all sales of products made on the website "Popeline de Cactus" (hereinafter referred to as "the Site"). The Site is operated by Pauline METTENET, artisan, whose registered office is located at 6, rue des Vosges, 67118 GEISPOLSHEIM, registered under the self-employed regime.

2. Acceptance of the T&Cs

Any order placed on the Site implies the unreserved acceptance of these T&Cs by the customer.

3. Products

The products offered for sale on the Site are handmade decorative items and craft materials. The essential characteristics of the products are presented on the Site.

4. Prices

The prices of the products are indicated in euros excluding taxes (HT), in accordance with Article 293 B of the French General Tax Code, which provides for a VAT exemption for self-employed individuals whose annual turnover does not exceed certain thresholds. Delivery costs are the responsibility of the customer and are indicated at the time of order confirmation.

5. Order

To place an order, the customer must create an account on the Site and follow the steps of the ordering process. Confirmation of the order implies acceptance of these T&Cs, the prices, the product descriptions, and the delivery terms.

6. Payment

Payment for the products is made by credit card or via PayPal. The payment is secure, and the customer's bank details are protected.

7. Delivery

The products are delivered to the address indicated by the customer at the time of ordering. Delivery times are indicated on the Site and may vary depending on the products and the destination. In case of delivery delay, the customer will be informed by email.

8. Right of Withdrawal

In accordance with Article L. 221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties, except for return costs. To exercise this right, the customer must inform Pauline METTENET of their decision to withdraw by email at contact@popeline-de-cactus.com.

9. Liability

Pauline METTENET cannot be held liable for the non-performance of the contract concluded in the event of force majeure, fault of the customer, or an unforeseeable and insurmountable event by a third party to the contract.

10. Intellectual Property

All elements of the Site, including texts, images, graphics, logos, icons, sounds, and software, are the exclusive property of Pauline METTENET or her partners. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or process used, is prohibited, except with the prior written authorization of Pauline METTENET, in accordance with Articles L. 335-2 and following of the French Intellectual Property Code.

11. Use of Images from DMC, Rico Design, and Bobbiny

The images of DMC, Rico Design, and Bobbiny products used on the Site are provided with the authorization of these companies. The use of these images is strictly limited to the presentation of DMC, Rico Design, and Bobbiny products on the Site and cannot be reproduced or used for other purposes without the express authorization of these companies.

12. Personal Data

Personal data collected on the Site is processed in accordance with the privacy policy available on the Site and in compliance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, amended by Law No. 2004-801 of August 6, 2004, and the General Data Protection Regulation (GDPR) of April 27, 2016.

13. Disputes

These T&Cs are subject to French law. In the event of a dispute, the parties will endeavor to resolve it amicably. Failing this, the French courts will be competent, in accordance with Articles L. 612-1 and following of the French Consumer Code.

14. Modification of the T&Cs

Pauline METTENET reserves the right to modify these T&Cs at any time. The modifications will be enforceable against the users of the Site from the time they are posted online and cannot apply to transactions concluded previously.
